    medmix Switzerland Ltd., formerly known as Sulzer Mixpac Ltd., operates globally
    in the field of static mixing tips, cartridges and dispensing devices for the dental sector. Recently, substantially identical copies of the static mixing tips for two-component cartridges and syringes have been discovered, including the patent-protected revolutionary T-Mixer mixing tip. These copies by other manufacturers are not subject to medmix’ s strict quality controls and are not covered by its warranty. In the interests of its clients, medmix will continue to take legal steps against all such copies.
     

    Starting in 2013, medmix introduced its T-Mixer dental mixing tip – a next generation of patent-protected revolutionary shorter mixing tip geometry. It reduces material waste by up to 40%, relative to the standard helical mixing tip geometry. T-Mixer has been a repeated Dental Advisor Product Award winner. The innovative technology behind the T-Mixer dental mixing tip allows for a more compact volume and length of the mixing tip by creating a higher number of mixing layers internally and is protected by several patent families in key countries around the globe.

    In 2017 patent-infringing copies of medmix’ s T-Mixer product were first found in both the United States and Brazil and were successfully stopped by means of a court action and out-of-court settlement concerning the patent infringement. The particular T-Mixer patent in this dispute also survived a challenge to its validity before the patent office in unamended form. Mixpac has continued to effectively enforce these T-Mixer rights over the years in several on-line enforcement actions and out-of-court settlements.

    medmix has successfully enforced its rights over the years in many dozens of court actions against, or out-of-court settlements with, slavish imitators of its various dental mixing tips as well as to successfully enforce its patent, trademark or other IP rights against certain infringing CANDY COLOR mixing tips in many countries, such as Germany, Italy, India, Japan, Brazil, the US, and the United Kingdom.

    Despite these measures, in 2019 to 2021 unfair slavish and patent-infringing copies of the new generation T-Mixer mixing tips were discovered on the internet and at trade shows in China and the United States. Action was taken. For example, ads for counterfeit T-mixing tips were taken down on various e-commerce websites, and counterfeit mixing tips were discovered at the Sino Dental China trade show.

    Concerning the Chinese trade show, Mr. MAO Shengqin, legal representative of Huaxian County Enjoys The Star Dental Equipment Trade Co. Ltd (滑县星光齿科器材贸易有限公司) of Henan Province, China, promised in an out-of-court settlement that he would never sell or exhibit the counterfeit T-Mixer products in the future. Medmix also filed a complaint at the Huizhou Intellectual Property Office for infringement of its patent, ZL201210252389.X, against the Chinese manufacturer of the counterfeit products, Huizhou Dengbos Mouth Beauty Consumables Factory (惠州市登柏士口腔美妆耗材厂) of Huizhou City, Guangdong Province, which went to trial in July 2021. In an out-of-court settlement in late 2021, the legal representative of Dengbos, Mr. TAN Jinhui, apologized and promised to pay medmix compensation for the infringement; to destroy promotional materials, products, drawings and molding tools related to the infringement; and not to offer products infringing medmix’ s intellectual property rights under a RMB 1 million penalty for violation.

    During the Greater New York Dental Meeting in Dec. 2021, medmix filed a complaint at the USDC SDNY court against two defendants operating virtual storefronts on www.amazon.com. The defendants Shenzhen Shi Baoan Qu Xin’An Jie Buxin Famous Firm d/b/a Oyemsunny and Chen Lingling d/b/aWenboer offered copies of T-Mixer mixing tips on Amazon. medmix’s pending complaint seeks damages, injunctive and other relief for patent infringement, trademark counterfeiting, trademark infringement and related claims.
